General Conditions of Sale (GCS)
Preamble
These general terms and conditions of sale, governed by Articles L.111-1 et seq. of the French Consumer Code, determine the rights and obligations of the parties. By confirming their order on the website accessible at the address "https://www.domainesingulier.com", the user declares having read and accepted the General Terms and Conditions prior to placing their order. Confirmation of the order therefore constitutes acceptance of the general terms and conditions of sale.

2 – PURPOSE OF THE GTC
The general terms and conditions of sale described below detail the rights and obligations of D-SINGULIER and its customer in connection with the sale of any product presented on the website www.DOMAINESINGULIER.com. They aim to define the reciprocal obligations between the seller and the customer. D-SINGULIER reserves the right to modify these General Terms and Conditions of Sale, hereinafter referred to as the GTC, at any time. However, the General Terms and Conditions of Sale applicable to the order are those accepted by the buyer at the time the order is placed. The parties agree that their relationship will be governed exclusively by this contract, to the exclusion of any other conditions. The items offered for sale may not be transferred, of any nature whatsoever.
All users of the site agree to comply with these General Terms and Conditions, without restriction or reservation, whether they visit the site or place an order. The customer is required to read them before placing an order. Validation of the order therefore constitutes acceptance of the general terms and conditions of sale.
3 – PRODUCTS
Items displayed on the website www.DOMAINESINGULIER.com are only available while stocks last. If a product is unavailable, D-SINGULIER will inform the buyer as soon as possible by email. The buyer will then have the option to choose another item or cancel their order and receive a refund.
Any complaint from the customer regarding the order or delivery of an unavailable item will be considered unfounded.
D-SINGULIER strives to describe the products offered for sale as accurately as possible. However, if any errors occur in this presentation, D-SINGULIER cannot be held liable. Users who wish to receive additional information about a Product are invited to contact Customer Service at the following address: avotreservice@domainesingulier.com
The illustrations and photos of the products used to support the text do not form part of the contractual scope. D-SINGULEIR makes every effort to ensure that the photographs of the Products are as consistent as possible with the Products actually delivered to the Customer. Under no circumstances can D-SINGULIER be held liable on the basis of said illustrations/photos.
4 – PRICE
The sales prices of products online on the DOMAINE SINGULIER Website, indicated in euros, and inclusive of VAT, are those in effect at the time the Order is placed by the Buyer. The sales prices of the products may be modified by D-SINGULIER at any time. This modification will be notified to the Buyer before any Order.
These prices do not include shipping costs, which are charged in addition to the price of the products purchased. Shipping costs will be indicated before the Order is registered by the Buyer. The various shipping methods are listed on the Site; they may be modified at any time by D-SINGULIER.
Prices include the value added tax (VAT) applicable on the day of the Order. Any change in the applicable VAT rate will be automatically reflected in the price of products sold by D-SINGULIER on its Site.
5 – ORDER
Any Order constitutes acceptance of these General Terms and Conditions of Sale, without prejudice to any specific contractual conditions entered into between the Parties. Contractual information is presented in French and English. Before confirming their Order, the buyer has the opportunity to check the details of their draft Order and correct any errors.
The distance selling contract is concluded from the moment the buyer confirms his order by validating the payment. He is considered to have knowingly accepted the content and conditions of the Order in question and in particular these General Conditions of Sale, the fact that his Order implies an obligation of payment on his part, the prices, volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by the buyer. The Buyer's credit card will be debited immediately upon validation of the order.
Once this step has been validated, the buyer will no longer be able to cancel his Order. The sale will be final (subject to the buyer exercising his right of withdrawal under the conditions provided for in Article 8 of these General Terms and Conditions of Sale). The Order will be confirmed to the buyer by any appropriate means and an email will be sent to him when his Order is shipped.
In the event of unavailability of one or more Products after placing the Order, the Customer will be notified by email.
The Customer will have the choice of being reimbursed the amount corresponding to the unavailable Products, or of being delivered when the Products concerned are back in stock (unless permanently withdrawn from the catalog).
6 – PAYMENT CONDITIONS
The price is payable in cash, in full on the day the order is placed by the Customer, by secure payment, according to the following terms:
- via the Shopify payment platform which supports bank cards: Visa, MasterCard
- Or via the secure payment platform by Paypal.
Payment data is exchanged in encrypted mode.
Bank details only circulate on the Internet in encrypted form and are never stored by the Seller. The Customer's order may be subject to 3D Secure verification. 3D Secure is an authentication payment system that guarantees optimal security when purchasing online. When paying, the Customer's bank verifies the identity of the cardholder before validating the transaction. In order to protect itself against certain abusive practices by fraudsters, the Seller checks the orders that have been validated on its site. As part of this check, the Seller's customer service may be required to ask the Customer for certain supporting documents, such as proof of address or the name of the person indicated for the delivery address, etc.
The Seller shall not be required to deliver the Products ordered by the Customer if the latter does not pay the price in full under the conditions indicated above.
Payments made by the Customer will only be considered final after actual collection of the sums due by the Seller.
Late payment will result in the immediate payment of all sums owed by the Customer, without prejudice to any other action that the Seller may be entitled to take against the Customer in this regard.

No additional costs, greater than the costs incurred by the Seller for the use of a means of payment, may be charged to the Customer.
7 – DELIVERY
Delivery is constituted by the transfer to the Customer of physical possession or control of the Product.
Delivery costs will be specified on the Site, all taxes included, during the Order process and must be accepted by the Customer at the time of validation of the Order. They will appear on a specific line separate from the one specifying the price of the Products.
It is expressly stated that the amount of delivery costs may vary depending on the territory of delivery of the Products, which the Customer expressly acknowledges and accepts.
Delivery times are indicated on the Site and depend on the delivery method chosen by the Customer. Delivery times are valid for working days. In application of Article L. 216-1 of the Consumer Code, the Parties agree that the Products will be delivered within the time limits specified during the Product Order process and before validation of the said Order.
Deliveries are made by La Poste. In this regard, it is specified that delivery times are likely to vary depending on the destination. In the event of a delay in shipping an order, D-SINGULIER will inform the consumer of a new delivery time. In accordance with Article L. 216-1, paragraph 2 of the Consumer Code, D-SINGULIERI undertakes to respect the maximum period of 30 days from the conclusion of the contract. Delivery delays within the legal framework of 30 days cannot give rise to any penalty or compensation, nor can they be grounds for cancellation of the order.
For information purposes, here are the usual delivery times provided by La Poste via Colissimo (after dispatch of our products) :
France: less than or equal to 5 working days;
Europe: less than or equal to 8 working days.
The Customer undertakes to check, at the time of delivery, that the Order delivered is complete, compliant and has not been damaged. Otherwise, the Customer undertakes to refuse to accept the Order and to affix his signature on any supporting document. Any Order received against signature by the Customer will be considered to be compliant, complete and in perfect condition at the time of delivery.
8 – RETURN / EXCHANGE
In accordance with Article L221-24 of the French Consumer Code, the buyer has 14 days to exercise his right of withdrawal. Within 14 days of the date of receipt of the ordered goods, the buyer can therefore request the exchange or refund of the item(s) purchased without having to provide reasons or pay a penalty. The Products must be returned in their original packaging and in new condition allowing them to be put back on the market, accompanied by the purchase invoice.
This right of withdrawal does not apply to perfumes that have been used or tried.
Beyond the 14-day period, DOMAINE SINGULIER will be free to refuse the exchange, credit note or refund.
To exercise the right of withdrawal, the Customer must notify DOMAINE SINGULIER (45 rue des dames 75017 Paris – avotreservice@domainesingulier.com) of their decision to withdraw before the expiry of the deadline by means of an unambiguous declaration. If the right of withdrawal is exercised within the aforementioned period, only the price of the Product(s) purchased and the delivery costs will be refunded. Return costs remain the responsibility of the Customer.
The return of the Product is carried out at the Customer's risk. If the package is lost, stolen or damaged during the return of the product, D-SINGULIER reserves the right to refuse reimbursement for the returned product(s).
The exchange (subject to availability) or refund will be made within 14 days of receipt by the Seller of the Products returned by the Customer under the conditions set out in this article.
9 – CONFIDENTIALITY
In accordance with the "Informatique et Libertés" law n°78-17 of January 6, 1978, as amended, the processing of the Client's personal data is governed by the CNIL and the Client has the right to access, modify, rectify and delete data concerning him by contacting DOMAINE SINGULIER D-SINGULIER (45 rue des Dames 75017 Paris, avotreservice@domainesingulier.com

10 – INTELLECTUAL PROPERTY
The DOMAINE SINGULIER website and all visual, textual, and audio elements contained therein are the exclusive property of D-SINGULIER. Any total or partial reproduction without consent is prohibited and punishable by law.
11 - RESPONSIBILITIES
D-SINGULIER cannot be held liable for any events, inconveniences or damages inherent to the use of the Internet network, particularly in the event of service interruption, external intrusion or the presence of computer viruses.
Furthermore, D-SINGULIER cannot be held responsible for the non-performance of the contract concluded in the event of unforeseen circumstances, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flooding, fire. D-SINGULIER will not incur any liability for any indirect damages resulting from this contract, loss of business, loss of profit, damages or costs, which may arise.
12 – LEGAL GUARANTEES
The products sold on the site www.DOMAINESINGULIER.com are subject to the legal guarantee of conformity set out in articles L.217-4 et seq. of the Consumer Code and to the guarantee against hidden defects set out in articles 1641 et seq. of the Civil Code.
